Terms and conditions for Frosted Finish window frosting services

These Terms of Service ("Terms") govern your use of services provided by Frosted Finish ("we", "our", or "us") and constitute a legally binding agreement between you and our company.

1. Acceptance of Terms

By engaging our window frosting services or using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Provided

Frosted Finish provides professional window frosting and privacy film installation services throughout Sydney, including:

  • Residential window frosting and privacy film installation
  • Commercial window frosting solutions
  • Decorative glass film application
  • Privacy window film installation
  • Custom frosting design and installation
  • Consultation and measurement services

3. Service Areas

We provide services across Sydney, with primary focus on:

  • North Shore suburbs
  • Northern Beaches region
  • Greater Sydney metropolitan area
  • Other areas by arrangement (travel charges may apply)

4. Quotes and Pricing

All quotes are provided free of charge and are valid for 30 days unless otherwise specified. Pricing includes:

  • Material costs (frosting film and adhesives)
  • Professional installation labor
  • Site consultation and measurement
  • Clean-up and waste disposal

Additional charges may apply for:

  • Travel outside standard service areas
  • Complex or custom designs requiring additional time
  • Emergency or after-hours services
  • Additional site visits beyond the initial consultation

5. Payment Terms

  • Payment terms are Net 14 days from invoice date
  • For larger projects, a deposit may be required before commencement
  • Payment can be made via bank transfer, cash, or approved payment methods
  • Late payment fees may apply for overdue accounts
  • All prices are in Australian Dollars (AUD) and include GST where applicable

6. Warranty and Guarantees

Installation Warranty

We provide a 12-month warranty on our installation workmanship, covering:

  • Proper adhesion of frosting film
  • Edge sealing and finishing
  • Bubble-free installation

Material Warranty

Frosting materials carry manufacturer warranties (typically 5-10 years) covering:

  • Film degradation and discoloration
  • Adhesive failure under normal conditions
  • Manufacturing defects

Warranty Exclusions

Warranties do not cover:

  • Damage from improper cleaning or maintenance
  • Damage from impacts, scratches, or deliberate interference
  • Normal wear and tear
  • Damage from extreme weather events or building movement
  • Changes in window condition after installation

7. Customer Responsibilities

Customers are responsible for:

  • Providing accurate information about window types, sizes, and current condition
  • Ensuring all windows are clean and free from debris before installation
  • Confirming glass type (tempered, laminated, single/double glazed) and any special requirements
  • Ensuring safe access to work areas and providing stable ladders or scaffolding if needed
  • Removing or protecting valuable items near work areas (within 2 meters of windows)
  • Providing adequate parking and access for our team and equipment
  • Notifying us of any structural issues, water damage, or window defects before work
  • Following recommended maintenance and cleaning procedures post-installation
  • Making payment according to agreed terms
  • Being available during installation for any questions or approvals

Pre-Installation Requirements

Before installation can commence, customers must ensure:

  • Windows are thoroughly cleaned on both interior and exterior surfaces
  • Any existing window treatments (blinds, curtains, security screens) are removed
  • Power outlets are available within 10 meters of work areas for our equipment
  • Building access is available during business hours (7AM-6PM weekdays)
  • Property owners have advised all occupants of the installation schedule

7.1 Window Condition and Installation Process

Window Assessment

Before commencing any frosting work, we will assess your windows for:

  • Suitability for frosting film application
  • Existing damage, cracks, or defects
  • Glass type and thickness compatibility
  • Frame condition and sealing integrity
  • Any obstructions or structural issues

Installation Process

Our professional installation process includes:

  • Precise measurement and templating of each window
  • Professional surface preparation and cleaning
  • Application of high-quality frosting film using industry-standard techniques
  • Edge sealing and finishing to prevent peeling or bubbling
  • Quality inspection and customer approval before completion
  • Clean-up of all installation materials and debris

Window Exclusions

We cannot install frosting on windows that are:

  • Severely damaged, cracked, or structurally compromised
  • Made of non-standard materials not compatible with our films
  • Located in areas requiring special safety equipment or permits
  • Subject to extreme temperature variations or direct heat sources

9. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law and the Competition and Consumer Act 2010 (Cth):

  • Our total liability is limited to the cost of the services provided or $10,000 (whichever is greater)
  • We are not liable for indirect, consequential, or special damages including loss of profits or business interruption
  • We maintain $20 million public liability insurance and $2 million professional indemnity insurance
  • Nothing in these terms excludes or limits liability that cannot be excluded under Australian Consumer Law
  • We are not liable for pre-existing window damage, structural issues, or building movement
  • We are not responsible for delays caused by building access issues or customer unavailability

NSW Fair Trading Act Compliance

Our services are provided in accordance with the Fair Trading Act 1987 (NSW) and associated regulations. We are licensed and insured to provide window frosting services in New South Wales.

10. Cancellation and Rescheduling

Customer Cancellations

  • Free cancellation with 24 hours notice
  • Cancellations with less than 24 hours notice may incur a call-out fee
  • Materials ordered specifically for your project may be non-refundable

Weather and Unforeseen Circumstances

We reserve the right to reschedule services due to weather conditions, safety concerns, or other circumstances beyond our control. No fees apply for rescheduling due to such circumstances.

11. Intellectual Property

All custom designs, techniques, and processes developed by Frosted Finish remain our intellectual property. Customers receive a license to use installed frosting for the intended purpose only.

12. Privacy and Data Protection

Your personal information is handled in accordance with ourPrivacy Policy. We may use photos of completed work for marketing purposes with your consent.

13. Dispute Resolution

In the event of any disputes:

  1. Contact us directly to discuss the issue
  2. We will work in good faith to resolve the matter
  3. If unresolved, disputes may be referred to the NSW Civil and Administrative Tribunal (NCAT)
  4. These terms are governed by the laws of New South Wales, Australia

14. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, supply chain disruptions, or public health emergencies.

15. Modification of Terms

We reserve the right to modify these terms at any time. Updated terms will be posted on our website and apply to future services. Existing contracts remain subject to the terms agreed at the time of service.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Australian Consumer Law Notice: Our window frosting services come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

NSW Home Building Act: For residential work valued over $500, we are licensed under the Home Building Act 1989 (NSW) and our work is covered by the Home Building Compensation Fund.
